TRAFFIC OFFENSES

Attorneys

If you would like to resolve a traffic citation without the need of appearing for court, you need to do the following:
1. File an Entry of Appearance with the court.
2. Email your Entry of Appearance, a copy your client’s driving record, and a request for recommendation to phelpstraffic@prosecutors.mo.gov.
3. Within one week you should receive an email response with a proposed disposition and instructions on how to proceed.
4. Follow the instructions in the email.  If that includes payment of a fine and court costs, make sure you mail the payment to Court. (NOTE· All checks must be payable to the Circuit Clerk)
5. If you do not resolve your client’s case before the next court date, you MUST appear in Court or a warrant may be issued for your client’s arrest.  Appearances via Webex are permitted, contact the Circuit Clerk for directions.
6. Verify that your payment has been received and your case has been resolved by contacting the Circuit Clerk at (573) 458-6210 

Pro Se Defendants

3. Within one week you should receive an email response with a proposed disposition and instructions on how to proceed.
4. Follow the instructions in the email.  If that includes payment of a fine and court costs, make sure you mail the payment to Court. (NOTE· All checks must be payable to the Circuit Clerk)
5. If you do not resolve your case before the next court date, you MUST appear in Court or a warrant may be issued for your arrest.  Appearances via Webex are permitted, contact the Circuit Clerk for directions.

The possible punishment for traffic tickets can range anywhere from a small fine up to both a fine and jail time. NOTE: Only infractions can be handled by mail. If the charge is driving while intoxicated, driving while suspended/revoked, no valid operator’s license, careless and imprudent driving, involves a traffic accident, or exceeding the posted speed limit by 25mph or more there will have to be a court appearance.

Insurance Tickets

When submitting proof of insurance, please make sure it is from the time frame in which the ticket was received.

Registration Tickets

When submitting proof of registration, please make sure it is for the correct vehicle.
